The Torbay Local Plan provides a framework for the sustainable development of Torbay up to 2011. It aims to maintain a balance between the need to provide homes, jobs and community facilities and at the same time to protect the high quality of Torbay's environment which is clearly so important to the overall attractiveness of the area. Planning applications are determined within the policies and proposals set out in the Local Plan and any development has to be in accordance with these policies.
The Adopted Plan was adopted with modifications on 5th April 2004. Together with the adopted Devon Structure Plan 2001 to 2016, this provides the basis for land-use planning until superseded by the Local Development Framework (LDF) and Regional Spatial Strategy (RSS) (see below). The preparation of the Plan is a statutory process which involves a number of formal stages leading up to its eventual adoption, and the Adopted Plan supersedes all other versions of the Torbay Local Plan. The Government has subsequently introduced changes to the planning system. Following the commencement of the Planning and Compensation Act in September 2004, work commenced on preparation of the Torbay Local Development Framework 2005-2026. Preparation of the Regional Spatial Strategy for the South West 2006-2026 also started at this time. The LDF and RSS will provide the basis for the first review of the Adopted Plan. Until the LDF has been completed, the Local Plan (and Structure Plan) are ‘saved’ plans.
Under the 2004 Act, the policies and proposals of the Local Plan and Structure Plan were saved until September 2007. Following application to the Secretary of State in March 2007, all but three policies in the Adopted Local Plan have been saved for a further three years to ensure continuity in the plan-led system. the relevant documentation relating to the further saving of Local Plan policies can be accessed via the link below.
Following a similar application by the County Council, the policies of the Adopted Devon Structure Plan have also been saved, until superseded by the emerging RSS. The relevant link is set out in the 'External Links' to the right hand side of this page.
The Adopted Plan is available for purchase at a price of £50 (plus £10 P&P), comprising a Written Statement and Proposals Map Booklet with Key and Town Centre Inset Maps, accompanied by the Environmental Guide. A CD-ROM version of the Plan is also enclosed in every folder. Alternatively, the CD-ROM can be purchased on its own for £5.
