If you wish to temporarily deposit building materials, rubbish or other items in a street or make a temporary excavation you must have consent from the highways authority (Torbay Council).
Eligibility Criteria
You must comply with any conditions attached to a consent and comply with requirements relating to the fencing off and lighting of deposits or excavations. Works on the highway must be supervised by a person competent in Chapter 8 of the Traffic Signs Manual.

Application Process
To apply for a permit, you can complete the application form and post back to us with your payment and copy of your Public Liability Insurance (The minimum level of such insurance shall be £5,000,000 but it shall remain the responsibility of the applicant having taken any necessary professional advise to determine the appropriate level of cover).
Application Notice Period
3 types of application can be applied for:
- Major Works, where a licence period of between 10 and 28 days is required. These applications must be made 3 months in advance of the start date. Renewals of Major Works licences must be applied for giving 10 days notice and will be for a maximum of 28 days.
- Standard Works, for a maximum licence period of 10days. Applications or renewals made with less than 10 days notice will attract enhanced charges.
- Emergency Works, for a maximum licence period of 10 days but enhanced charges will apply.
Fees
The cost will vary subject to notice given and if a site visit is required. The charges are revised each year and will be posted here:
From 1 April 2011
- £37.75 - Over 10 days notice given*
- £75.25 - 10 days or less notice given*
- £75.25 - Site visit required
- £20 per licence per parking space occupied. where the licence occupies on street Pay and Display parking spaces during chargeable times.

Failed Application/Licence Holder Redress
Please contact Torbay Council in the first instance. If you wish to appeal against a decision you may do so to the local Magistrates' court.
Cancelled Licenses
Where the applicant withdraws a licence application, fees will still be payable if Torbay Council has completed the administration of the application.
Complaint Regarding Location/Dangerous Scaffolding
Any complaints about the location or safety of materials on the public highway should be reported instantly using the contact details on the right and one of our inspectors will go to the site to assess the safety and this will be dealt with accordingly.
Where the conditions of the licence have not been met, the licence holder is liable to pay the cost of a site visit as detailed above.
